Designated or Identified Positions
A designated or identified position is where an employer specifies that a role is to be filled only by a person with a particular attribute. This includes an Aboriginal or Torres Strait Islander applicant, a person with a disability, a person of a particular sex or a person of a particular age.
The Equal Opportunity Act 2010 makes it clear that designated or identified positions are classified as “special measures” which are allowed and are not discriminatory.
Designated or identified positions are designed to help eliminate inequalities for groups that may experience significant disadvantage when it comes to employment, such as Aboriginal and Torres Strait Islander people, people with disabilities, women and young people. These positions also benefit employers by allowing them to hire a person with particular skills and expertise, such as cultural knowledge.
For example, an organisation with very little Aboriginal representation amongst its workforce can advertise for and employ Aboriginal people to help address this diversity issue.
An employer may also seek a temporary exemption to allow for an identified position where a position created is for a person of a particular age, sex or a person with a disability and permanent exemptions do not apply.
