Pool and spa safety reminder for Brimbank residents

Summary

As the warmer weather approaches, Brimbank Council is reminding residents to make sure their pools and spas have working safety barriers in place, to ensure the safety of young children around water.

It is a legal requirement that all swimming pools and spas capable of holding water 300mm deep or more must have barriers to prevent unsupervised children gaining access.

Brimbank Mayor Cr Margaret Giudice said Council has an ongoing pool compliance program to ensure the safety and wellbeing of everyone in the community, especially young children.

“Anyone with a pool or spa needs to ensure their pools or spas are in safe working order and comply with all safety measures.

“Barriers around a pool or spa and constant supervision, especially with children under the age of 5 years, are two important safety measures that can help keep young children safe around pools and spas.

“Pools can be lots of fun, however having a pool also comes with responsibilities and legal requirements. Poorly fenced pools are a big risk, especially to children.

“If Council finds non-compliance a building notice is issued and the owner is given a set period of time to bring the pool into compliance with the current legislation,” Cr Giudice said.

New swimming pools in Victoria require four-sided pool fencing as stated in the Building Code of Australia 2016 and the relevant Australian Standard (AS 1926.1-2012 and AS 1926.2-2007 (including Amendments 1 &2)).

Remember that:

  • New swimming pools in Victoria require four-sided pool fencing. Alterations and/or new barriers for a swimming pool or spa require a building permit.
  • Anyone who fails to comply with the legislative requirements may be liable to penalties exceeding $7000.
  • Inspections can be requested by Council building inspectors to ensure pool or spa barriers are up to current standards and compliant (fees apply).
