Council has successfully prosecuted a rogue skip bin operator who was using industrial land in Reid Street, Ardeer for an illegal recycling business.

At the Sunshine Magistrates Court on 4 March 2016, the tenant operator was found guilty and ordered to pay fines and costs of over $65,000.

Chair of Brimbank Administrators John Watson said “The verdict sends a clear message that illegal land uses will not be tolerated within Brimbank.

“Council does not hesitate to take enforcement action against those businesses that fail to get proper planning approval and flout environmental controls.

“After a thorough investigation and giving the operator ample time to comply, Council commenced legal proceedings in early 2015 for the skip bin operator to cease and the site to be cleaned up,” Mr Watson said.


No Planning Permit Equals Hefty Fine
Council commenced Magistrates Court proceedings against the tenant operator, for repeated failure to obey the VCAT order and failing to obtain a planning permit for the use.

The land owner was also found guilty of not obtaining a planning permit for the use of the land and ordered to pay costs and fined $500.

“It is pleasing to see that Council’s efforts to make sure businesses in Brimbank’s industrial areas operate in accordance with planning and environmental controls are paying off.


Report Illegal Dumping
“Community members can help by reporting any incidences of illegal land uses or dumping to Council on 9249 4000 and we will investigate,” Mr Watson said.
